Indemnity Declaration.
All competitors must have read and understood this Indemnity/Declaration, prior to applying for entry.
Competitors are deemed to have done so, and to abide by the terms of this Indemnity/Declaration when entering the race. Where an entry is undertaken by a parent/guardian or team leader on behalf of a Competitor - be they a Junior (ie 15yrs and under 19yrs on 1st January of the year of the race) or older, it is deemed that the competitor will have read and understood this Indemnity/Declaration and agreed to the terms therein as a condition of race entry. The entry must be confirmed by the afore mentioned parent/guardian or team leader on behalf of the Competitor.
Any Competitor who does not wish to abide to by the race rules, and the terms of this Indemnity/Declaration, should not enter. Any disregarding of the race rules and terms of this Indemnity/Declaration by any competitor will risk the disqualification of that competitor and their crew member (if applicable) prior to, during or after the race. Competitors must agree to abide by these terms before applying for entry.
Details of the Indemnity/Declaration are as follows (where “the undersigned” refers to the Competitor(s) within a crew):
• I/We, the undersigned, declare that I/We have read and accept the Limitation of Liability (below) on behalf of the crew and our supporters, and undertake to read and comply with the Rules and Advice (“the rules”) as published from time to time and to ensure that all supporters are acquainted with such Rules and Advice. Limitation of Liability Accepted by the Competitor(s) and/or the Signer on their behalf:
• For the avoidance of doubt, the term 'Competitor' shall include crew member, support crew member and fellow club/unit members and the term 'Organisation' shall mean "The Devizes to Westminster Organisation Ltd.".
• Every Competitor is referred to the rules and advice dealing with safety requirements, fair conduct and the safe running of the race. The Handbook must be read in advance of entry, as published on the DW website at www.dwrace.co.uk.
• Every Competitor, by applying for entry, accepts that Canoeing is an Assumed Risk Sport and, that given the nature and challenge of the event, Competitors must be responsible for their own safety should they get into difficulties. Competitors accept that it is their responsibility to have adequate knowledge of the course and to withdraw from the race if they cannot cope with the conditions at any time. This shall not remove the right of the Organisation to require a Competitor(s) to stop should this be necessary for the safe running of the event, or the safety of a specific Competitor(s).
• Every Competitor, by applying for entry, agrees to comply with the rules and to take all necessary precautionary measures to minimise his/her own risk and shall be solely responsible for any loss, damage, personal injury or death suffered by him/her, or caused to third parties as a result of any act, default, neglect or omission by him/her.
• By entering the race, the Competitor(s) understand that the event may be held in extremely adverse conditions and the decision to start is solely that of the Competitor(s).
• Competitor(s) confirm that they have all the necessary equipment, skills and experience to deal with the course and weather that may present during the course of the race.
• Competitor(s) declare that they will be, during the Event, sufficiently fit and healthy to participate in the Event unaided and in accordance with the rules. If Competitor(s) are in any doubt, the DW Organisation requires that they seek medical advice. Competitors must declare any relevant medical details where requested in the official entry form.
• Competitor(s) accept that officials, at all times, reserve the right to refuse entry for persons considered to have insufficient experience and disqualify those who fail to follow the rules or cannot cope with the conditions presented.
• Furthermore, every Competitor undertakes to indemnify the Organisation in relation to any loss or damage suffered by the Organisation arising from the Competitor's participation in the event.
• The Organisation reserves the right to cancel or vary all or any part of the event before and/or during the event.
• Data Protection: For the purposes of Data Protection, “Personal Information” includes medical data collected for health and safety purposes: In taking part Competitor(s) agree that:
• The Personal Information relating to Competitor(s) can be stored and used by DW in connection with the organisation, staging, administration and communication of the DW Race.
• This information will be stored using DW’s chosen cloud based information management system, and Paddlers personal information will be deleted in a timely manner following the race.
• Medical information may also be used to allow medical assistance to be given to Competitor(s).
• The Personal Information relating to Competitor(s) may be anonymised and the anonymised data may be used by DW in connection with compilation of statistical information.
• Competitor(s) images can be used by DW, sponsors and event partners for the purposes of the promotion and marketing of the DW Race.
• Publicity: The organiser reserves the right to publicise the event by means of radio, television, print media and the Internet, as well as film and photo recordings of the events for its own press releases, PR and advertising purposes. The participant agrees to be filmed, photographed, interviewed and/or reproduced or presented in any other way during his/her participation in the event, and in this respect grants the organiser free of charge the rights of use in the representation of his person and his voice without restriction for the above mentioned purposes.
• Competitor(s) acknowledge and agree that in no event shall DW (their volunteers, or Directors) be liable to them, whether for breach of contract, any tortious act or omission (including negligence) or otherwise, under or in connection with the Event for any:
• loss or damage;
• loss of business, earnings, revenue or goodwill;
• loss of reputation;
• loss of anticipated savings;
• pledges made on Competitor(s) behalf or by Competitor(s) to charity;
• consequential or indirect loss, regardless of whether the loss or damage would arise in the ordinary course of events, is reasonably foreseeable, or is in the contemplation of the parties, or otherwise.
Confirmation of this Indemnity/Declaration:
Competitor(s) agree to abide by the rules and conditions laid down for the event, and confirm they have read the personal safety advice and the safety overview, and acknowledge that they understand them, by completing and submitting an entry form to the DW Race.
